This Application has been filed to condone the delay of 28 days in filing the present Original Petition.
2. Heard the learned counsels appearing on both sides.
3. The learned counsel for the respondent contends that there is no necessity to condone the delay as their application has been filed for condoning the delay much after the filing of the Arbitration petition in Arb.O.P.(Com.Div.). Dr.No.42065 of 2024.
4. Even though, the learned counsel for the respondent had vehemently contended that the application to condone the delay had not been filed along with the Arbitration O.P., but, had been filed on a subsequent date. Considering the averments made in the accompanying affidavit filed in support of this Application and having being satisfied with the reasons indicated therein and also considering the fact that the said O.P. had been filed wihtin the stipulated time, ofcourse with an Application to condone the delay which is this instant Application, I am Page No. 1 of 3
inclined to condone the delay of 28 days in filing the present Original Petition.

5. However, this Court is inclined to impose a cost of Rs.5,000/- (Rupees Five Thousand only) on the applicant to be payable to the respondent within a period of two weeks from the date of receipt of a copy Accordingly, this Application is order as prayed for.
6. Registry is directed to number the petition in Arb.O.P.(Com.Div.). Dr.No.42065 of 2024 on production of compliance of payment of costs.
