ORDER
The Criminal Original Petition has been filed to direct the learned Judicial Magistrate No.V, Coimbatore to expedite and complete the trial of the case in C.C.No.82 of 2018.
2. This Court by order dated 09.06.2022 directed the learned trial Judge to file a report as to the pendency of C.C.No.82 of 2018 and also to indicate the stage of the proceedings to this Court on or before 27.06.2022. The learned trial Judge vide proceedings D.No.861 of 2022 dated 16.06.2022 informed this Court that the C.C.No.82 of 2018 is posted on 23.06.2022 and that the defacto complainant has filed a petition under Section 216 Cr.P.C to alter the charges in the said case in Crl.MP.No.2030 of 2020 on 23.06.2022 and the same was posted on 23.06.2022 for enquiry.
3. When the petitioner herself said to have filed a petition and delaying the trial, this Court cannot issue a
direction to the learned trial Judge to expedite the trial. However, the learned trial Judge shall dispose of the Crl.MP.No.2030 of 2020 on merits and thereafter proceed the main case as expeditiously as possible.
4. With the above observation and direction the criminal original petition is disposed of.
