The civil revision petition is laid by the revision petitioner for a direction to the learned I Additional District Court, Coimbatore to dispose of the case in C.M.A. No.21 of 2019, within the time frame that may be fixed by this Hon'ble Court.
2. This court is informed that there is a matrimonial cause, where both the petitioner and the respondent have filed separate applications, one for dissolution of marriage filed by the husband and the other for restitution of conjugal rights filed by the wife. While the husband was successful before the court, the wife was not. Therefore, she had preferred two civil miscellaneous appeals in C.M.A. Nos.21 and 22 of 2019, which are now pending before the I Additional District Court, Coimbatore. The revision petitioner herein is the respondent in both the appeals. Even though the revision petitioner seeks an expeditious disposal of C.M.A. No.21 of 2019, it is very evident that the said civil miscellaneous appeal cannot be disposed of without considering it along with the other connected civil miscellaneous appeal, namely CMA No.22 of 2019.
3. The learned I Additional District Judge is now required to dispose of C.M.A. No.21 of 2019 along with connected C.M.A. No.22 of 2019, within a period of three months from the date of communication of this order, at any rate, not later than August, 2022.
5. With the above direction, the Civil Revision Petition stands disposed of. No costs.
