ORDER
The petitioner / wife seeks transfer of H.M.O.P.No.1 of 2026 pending on the file of the Family Court, Krishnagiri, to the file of the Family Court, Salem.
2. The learned counsel for the petitioner submitted that she is residing in her parents' house along with her 8 months old child and has no independent source of livelihood and he is living at Krishnagiri. He further submitted that now the case is pending before the Family Court, Krishnagiri. He would also submit that her husband filed the petition seeking for restitution of conjugal rights. Therefore, she seeks transfer of the proceedings to the Family Court, Salem.
3. Despite service of notice, there is no representation on the side of respondent.
4.Considering the submissions made by the learned counsel for the petitioner, this Court finds the reasons stated to be justifiable and is inclined to allow the transfer.
5. Accordingly, H.M.O.P.No.1 of 2026 pending on the file of the Family Court, Krishnagiri, is withdrawn and transferred to the file of the Family Court, Salem. The learned trial Judge is directed to issue notice to the respondent within a period of four weeks from the date of receipt of a copy of this order. Furthermore, immediately after receipt of papers, the learned Family Court, Salem is directed to refer the matter for counselling for not less then 5 hearings
and dispose the case after issuance of notice to both parties in accordance with law.
