The petitioner, who was arrested and remanded to judicial custody for the offences punishable under Sections 8(c) read with 22(C), read with 29(1) of NDPS Act, in Crime No.328 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused were found in illegal possession of 8 numbers of LSD Stamps which contains 130 mg. Hence, the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the earlier petition in Crl.O.P.No.3264 of 2023 was dismissed before this Court on 14.02.2023 and he will abide by any condition that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent would submit that the petitioner along with other accused were found in illegal possession of 8 nos of LSD Stamps which contains 130 mg. He would further submit that the petitioner has got 4 previous cases out of which, 2 cases are similar in nature. Hence, he vehemently opposed to grant bail to the petitioner.

5. Taking into consideration the facts and circumstances of the case, also considering the antecedents, and there is no change in circumstances, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, the Criminal Original petition is dismissed with the direction to the learned Principal Special Court under EC and NDPS Act cases, Chennai, to complete the trial within a period of three months from the date of receipt of a copy of this order.
