In this application, the applicant seeks for an extension of time for the arbitral tribunal, till 15.11.2019.

2. Heard the learned counsel for the applicant as well as the respondent.

3. According to the learned counsel for the applicant, the statutory period of one year for the arbitral tribunal expired on 15/11/2018 and thereafter by mutual consent, six months time was extended, which is expiring by 15.05.2019. Learned counsel would further submit that the arbitration proceedings reached the stage of final hearing, for which the dates have been fixed as 13, 14 and 15th April 2018, and thereafter it is for the arbitral tribunal to pass award and for the said purpose, the learned counsel seeks for extension of time for the arbitral tribunal.

4. I have considered the said submission made by the learned counsel for the applicant and I have gone through the averments made in the affidavit filed in support of the application. Since the arbitration proceedings have reached the final stage of hearing within the time stipulated and thereafter only the arbitral tribunal has to pass the final award, for the said purpose, this Court is of the view to allow further extension of six months for the arbitral Tribunal.

5. Accordingly, the mandate of the arbitral tribunal is further extended for six months from 16.05.2019, within which it is expected that the final award would be passed by the arbitral tribunal. Accordingly, this application is ordered.
