ORDER
The petitioner is the wife and the respondent is the husband. The respondent / husband filed G.O.P.No.16 of 2014 on the file of Principal District Judge, Krishnagiri, seeking custody of minor children. The petitioner / wife now resides at Cheyyar Town and she is taking necessary steps to change her residence at Chennai. Hence, she has filed this petition to transfer the petition in G.O.P.No.16 of 2014 to the file of Family Court, Chennai.
2. On notice, the respondent has entered appearance through counsel.
3. It is well settled law that in matrimonial disputes, the convenience of wife is given preference in the matter of place of hearing. Hence, I am of the view that G.O.P.No.16 of 2014 pending on the file of the learned Principal District Judge, Krishnagiri has to be transferred to the file of Family Court, Chennai.
4. In the result, the transfer CMP is allowed and the https://hcservices.ecourts.gov.in/hcservices/
learned Principal District Judge, Krishnagiri is directed to transfer the petition in G.O.P.No.16 of 2014 pending on his file to the file of Family Court, Chennai for disposal. No costs. Consequently, connected miscellaneous petition is closed. vsm This matter having been listed under the caption 'for Being mentioned' on 28.10.2015 pursuant to the order of this court dt.13.10.2015 and made herein in the presence of the aforesaid counsels on either side, the court made the following order; This matter is listed today under the caption for 'being mentioned' at the instance of the learned counsel for the petitioner.
2. This Court, by an order dated 13.10.2015 allowed the transfer CMP and directed the matter to be transferred to the file of Family Court, Chennai.
3. Today it is submitted by the learned counsel for the petitioner that the matter has been settled between the parties and hence he seeks permission of this Court to withdraw the petition and he has also made an endorsement to that effect.
