Heard the learned counsel on either side.

As rightly pointed out by Mr.S. Udayakumar, learned counsel for the appellant, as per clause 5 of the Memo of Compromise dated 11.08.2017, the parties had agreed to claim refund of court-fee. Even otherwise, as the matter was settled between the parties, the parties are entitled to refund of Court-fee. Hence, the court-fee paid paid in the counter-claim in the original suit before the City Civil Court has to be refunded by the City Civil Court to the defendant/counter claimant before the said Court and the entire court-fee in the Appeal Suit has to be refunded to the appellant by the Registry of this Court.
