IN THE HIGH COURT OF JUDICATURE AT MADRAS

( Criminal Jurisdiction ) Tuesday, the Twenty Eighth day of November Two Thousand Seventeen PRESENT The Hon`ble Mr Justice P. N. PRAKASH CRIMINAL MISCELLANEOUS PETITION No.14662 of 2017 IN CRL OP.10056/2017 1 S.VIJAYA, [ PETITIONERS ] 2 S.SIVAGNANA SUNDARAM, 3 VEDHA SUBBIAH, Vs INSPECTOR OF POLICE, [ RESPONDENT ] PEELAMEDU POLICE STATION, COIMBATORE CITY, COIMBATORE DISTRICT.

Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition imposed by this Hon'ble High Court in Crl.O.P.No.10056 of 2017 dated 11.09.2017 Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.S.SUGENDRAN, Advocate for the petitioner and of MR. J.KARUPPIAH, ADDL. PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- In Crl.O.P.No.10056 of 2017, this court, by order dated 11.09.2017, granted anticipatory bail to Vijaya (A1), Sivagnana Sundaram (A2) and Vedha Subbiah (A3) on certain conditions, one of which is that they shall execute a bond for Rs.10,000/- with two sureties one of whom should be a blood relative.

2. It is seen that Vijaya (A1) and Vedha Subbiah (A3) have executed the bond with sureties as directed by this court. However, Sivagnana Sundaram(A2) has not been able to execute the bond with sureties since he does not have any blood relative. Sivagnana Sundaram (A2) has filed an affidavit dated 12.10.2017, wherein in para no.4, he has stated that his father had passed away and that his mother and sister are living in Abroad.

3. The learned counsel for Sivagnana Sundaram(A2) submitted that his wife is willing to stand surety. In such circumstances, the order dated 11.09.2017 is partially modified to the effect that the condition relating to blood relative is deleted in respect of Sivagnana Sundaram(A2) and his wife may be permitted to stand surety. Rest of the conditions shall remain the same.

4. Two weeks time is extended from the date of receipt of a copy of this order to furnish the sureties. Since the modification is granted only to Sivagnana Sundaram(A2), it is not necessary for the Registry to issue any modified order and it would be sufficient if this order is sent to the Judicial Magistrate No.-VI, Coimbatore. -sd/- 28/11/2017 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
