O R D E R

(This case has been heard through video conference) The petitioner who apprehend arrest at the hands of the respondent police for the offences publishable under Sections 379 and 430 of IPC in Crime No.104 of 2020 on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that on 18.03.2020 at about 18.00 hours when the respondent police was on usual patrol duty they found that the petitioner was trying to transport the river sand illegally in his two wheeler. Hence, the complaint. 3.The learned counsel appearing for the petitioner would submit that the petitioner is a innocent person and he has been falsely implicated in this case.

4.The learned Additional Public Prosecutor would submit that there were 10 previous cases pending against the petitioner. Hence, he vehemently opposed for grant of Anticipatory bail to the petitioner.

5.Taking into consideration of the facts and circumstances of the case and there was 10 previous cases pending against the petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, the Criminal Original Petition is dismissed.
