Though the petitioner has filed this Writ Petition challenging the impugned order dated 01.04.2022 made in R.C.No.1536/MM5/2015 passed by the respondent, and consequential seeking a direction upon the respondent to process his mining application dated 16.06.2008, however, when the matter was taken up for hearing today, the learned counsel appearing for the petitioner sought permission of this Court to file a fresh application without reference to the earlier rejection and also to challenge the Section 10A, 10B of the MMDR Act, 1957. An Endorsement to the said effect is also made by the learned counsel for the petitioner in the Petition today. The said endorsement is recorded.
2. In view of the endorsement made by the learned counsel appearing for the petitioner, this Writ Petition is dismissed with liberty as sought for. No costs. Consequently, the connected miscellaneous petition is closed.
