Respondent Prayer: This civil revision petition has been filed under Article 227 of the Constitution of India to direct the Hon'ble I Additional Family Court to proceed with the enquiry in O.P.No.3476 of 2008 without waiting for the report from the private doctor within a stipulated time fixed by this Hon'ble Court.

O R D E R

This civil revision petition is filed seeking for a direction to the I Additional Family Court to proceed with the enquiry in O.P.No.3476 of 2008 without waiting for the report from the private doctor within a stipulated time.

2. It is seen from the records that the petitioner has filed O.P.No.3476 of 2008 against the respondent before the Family Court, Chennai for dissolution of the marriage solemnized on 22.05.2005.

3. On 18.10.2012, the petitioner has filed his proof affidavit and thereafter, the family Court has sought a report from the private doctor after clinical examination of psychologists.

4. Mrs.A.Arulmozhi, learned counsel for the petitioner submitted that the original petition was filed in the year 2008 and the trial also commenced on 18.10.2012, however, the petition is being adjourned without any justifiable reason. The learned counsel further submitted that the delay had caused mental agony and hardship to the petitioner.

5. Considering the facts of the case and representation of the learned counsel for the petitioner, this Court is inclined to issue direction to the I Additional Family Court, to dispose of O.P.No.3476 of 2008 within a period of 3 months from the date of receipt of copy of this order on merits after calling for the report immediately or without the report.
