Mr.R. Rajasekaran, Government Advocate (Criminal Side) Order The petitioner who is the second accused in Cr.No.243 of 2022 on the file of the respondent police, filed this petition seeking to quash the same.

2. Learned counsel for the petitioner submits that the petitioner is innocent. He is an I.T.I. Graduate, and no weapons were recovered from him. Hence, he prayed for quashing of the said proceedings.

3. Learned Government Advocate (Criminal Side) submits that the respondent police found the petitioner along four persons planning to commit an offence. They were apprehended, and during enquiry, they gave contradictory statements. Later, weapons were recovered from them, and they were arrested. As regard the petitioner, it was further submitted that there is no previous case.

4. Considering the submission of the petitioner and perusal of the materials, it is seen that the weapons said to have been found in possession of the petitioner are wooden logs which are commonly available and not of a dangerous nature. Further, the petitioner and other co-accused are in the age group of 22 to 29 years. The acts alleged, at best, amount only to preparation and nothing more.

5. In view of the above, considering their age and their antecedents, this court quashed the case against the petitioner and other co-accused who are similarly place. Hence, Cr.No.243 of 2022 on the file of the respondent police is hereby quashed. This Criminal Original Petition is allowed. 04-06-2026 nl Index: Yes/No Speaking/Non-speaking order
