ORDER

The revision petitioner filed a suit in O.S.No.17 of 2012 on the file of the learned District Munsif-cum-Judicial Magistrate, Hosur, seeking declaration that one M.Thimmarayappa S/o Muniappa of Kothapalli Village, Hosur Taluk is dead. He was not heard for more than 9 years and further by declaring that the petitioners/plaintiffs herein are the only legal heirs of deceased (Missing person) M.Thimmarayappan and are entitled to get legal heir Certificate.

2.According to the petitioners, though necessary documents are filed before the said Court no order was passed by the trial Court and the suit was pending for more than 10 years. Hence, the petitioners have prefered the present civil revision petition for a direction directing the learned District Munsif-cum-Judicial Magistrate, Hosur to dispose the original suit in O.S.No.17 of 2012.

3.Heard on both sides, records perused.

4.It is seen that the suit was filed in the year 2012 and though necessary documents were produced before the learned trial Judge, no order was passed till date. Hence, the learned District Munsif cum-Judicial Magistrate, Hosur, is directed to dispose the above suit within a period of six weeks from the date of receipt of a copy of this order.

5.Accordingly, this civil revision petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed. 26.06.2023 vsn Index:Yes/No Internet:Yes/No 3/4
