PRAYER: This Criminal Original Petition is filed under Section 482 of Code of Criminal Procedure to direct the 2nd respondent to file final report in respect of CSR No.137 of 2015, dated 22.03.2015 on the file of 2nd Respondent police in order to punish the offender according to the law.

ORDER

This criminal original petition has been filed to direct the 2nd respondent to file final report in respect of CSR No.137 of 2015, dated 22.03.2015 on the of 2nd Respondent police in order to punish the offender according to the law.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents No.1 & 2.

3. It is seen that earlier this Court had passed an order in Crl.O.P.No.8726 of 2015 on 15.04.2015 directing the respondent police to conduct an enquiry in CSR No.137 of 2015.

4. It is the grievance of the petitioner that the police have not conducted the enquiry.

5. Hence, the respondent police is directed to expeditiously conduct the enquiry and if there is no case made out, the petition may be closed after giving a copy of the closure report to the complainant. If any cognizable offence is made out, the police shall register an FIR as held by the Hon'ble Apex Court in Lalita Kumari vs. Govt. of U.P. & others [2013 (4) Crimes 243 (SC).
