PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents 1 to 3 to consider and pass orders on the representation dated 18.02.2022 and 20.03.2023 filed by the third petitioner to deposit the remaining compensation amount in the Court Deposit or Government Treasury without prejudice to anyone till the pendency of the suit in O.S. No.431 of 2012 before the Subordinate Judge, Coimbatore. For Petitioners : Mr.S.Sivapandi For Respondents : Mr.P.Sathish, Additional Government Pleader for R2 & 3
ORDER
With the consent of both the parties, this Writ Petition is taken up for final disposal at the admission stage itself. 2.The writ petition has been filed seeking for a direction to respondents 1 to 3 to consider and pass orders on the representations dated 18.02.2022 and 20.03.2023, filed by the third petitioner to deposit the remaining compensation amount in the Court Deposit or Government Treasury without prejudice to anyone till the pendency of the suit in O.S. No.431 of 2012 before the Subordinate Judge, Coimbatore. 3/6
3.Since the Suit for partition is pending between the petitioners and the private respondents herein in O.S. No.431 of 2012 before the I Additional Subordinate Judge, Coimbatore, in which, the petitioners have also made an Application to implead the official respondents herein as defendants in the Suit, it would be appropriate that the present prayer seeking for direction can also be made before the concerned Civil Court. 4.In view of such an alternate remedy available, the prayer in the present writ petition does not deserve consideration. 5.The learned I Additional Subordinate Judge, Coimbatore is called upon to dispose of the petitioners' Application in I.A. No.6 of 2023 as expeditiously as possible, in any event, within a period of three months from the date of receipt of a copy of this order. 6.The petitioner is at liberty to seek for an injunction, sought for in the present writ petition before the concerned Civil Court, which Application shall also be decided expeditiously. 4/6
