ORDER

The petitioner apprehends arrest for the alleged offence under Sections 303(2), 326 of BNS Act, in Crime No.57 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner along with other accused transported 10 units of sand in a lorry. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) would reiterate the prosecution and submit that the petitioner has six previous cases. Hence, he opposed for grant of bail to the petitioner.

5. Considering the fact that petitioner has previous cases, this Court is of the view that the petitioner does not deserve anticipatory bail.

6. Accordingly, this Criminal Original Petition is dismissed. 25.03.2026 sma 2/4
