This application has been filed by the applicant/defendant to condone the delay of 2111 days in filing the written statement in the above suit C.S No.197 of 2016.

2. Heard both sides.

3.There is no objection by the learned counsel appearing for the respondent/plaintiff in allowing this application.

4. Having been satisfied with the reasons stated in the affidavit filed in support of the application and after hearing the learned counsel for the applicant, the delay is condoned and this application is allowed on condition that the applicant pays a sum of Rs.3,000/-(Rupees Three Thousand only) to the Adyar Cancer Institute, Adyar, Chennai, on or before 04.07.2022. In the event of failure on the part of the applicant in paying the said amount within the stipulated time, this application shall stand dismissed automatically without any further reference to this Court.
