ORDER

The petitioner/A1, who apprehends arrest for the alleged offence under Section 318(4) of the Bharatiya Nyaya Sanhita, 2023 (BNS), in Crime No.404 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The allegation against the petitioner/A1 is that he induced the de-facto complainant by promising that, if cars were purchased and handed over to him, he would rent the same and share the profits with him. It is further alleged that, by using the credentials of the de-facto complainant, the petitioner had purchased two cars. Subsequently, he sold those cars and absconded without paying the monthly installments. Hence, the case.

3. The learned counsel for the petitioner/A1 submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court and the petitioner is ready to cooperate for the investigation. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side), for the respondent, would submit that the petitioner has got one previous case; that the earlier

anticipatory bail application was dismissed by this Court on 17.02.2026; and that there is also no change in circumstances. Hence, he strongly opposed the grant of anticipatory bail to the petitioner.

5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent.

6. From the very fact that the petitioner/A1 has got one previous case, which clearly demonstrates that he has subverted the justice by using the liberty granted by this Court. Therefore, this Court is of the firm view that the petitioner does not deserve anticipatory bail.

7. Accordingly, this Criminal Original Petition stands dismissed. 26-03-2026 dk
