O R D E R

The present criminal original petition has been filed to direct the second respondent to register FIR on the complaint of the petitioner dated 21.12.2015, investigate the same and proceed in accordance with law.

2. The petitioner herein has lodged a complaint as against one Joseph Jerald and his wife Selvi Jerald on the allegation of cheating and misappropriation. Though the complaint has been lodged on 21.12.2015, no action has been taken on the said complaint till date. Hence, the petitioner has come forward with the present criminal original petition. https://hcservices.ecourts.gov.in/hcservices/

3. I have heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor appearing for the respondents.

4. When the matter was taken up for consideration, the learned Additional Public Prosecutor submitted that on receipt of the complaint of the petitioner, a detailed enquiry has been conducted on the complaint of the petitioner and thereafter, the said complaint has been closed.

5. In view of the submissions of the learned Additional Public Prosecutor, as the complaint given by the petitioner has already been closed, nothing survives in this petition.

6. Accordingly, this Criminal Original Petition is closed with liberty to the petitioner to work out his remedy in the manner known to law. The Second respondent is directed to serve a copy of the closure report to the petitioner within a period of one week from the date of receipt of a copy of this Order.
