ORDER

The petitioner apprehends arrest for the alleged offence under Sections 8(c), 22(c), 29(1) of the Narcotic Drugs & Psychotropic Substances Act, 1985 in Crime No.83 of 2025 on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that 1.30 grams of LSD, a commercial quantity, was recovered from the petitioner at the scene of occurrence. Hence, the case.

3. Learned counsel for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case by the respondent police. He further submitted that this is the second anticipatory bail petition and that there are two accused and the present petitioner is A1. He further submitted that at the relevant time, the petitioner was at his residence, which can be substantiated through CDR and CCTV footage. Hence he prays to grant anticipatory bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and, on instructions, submitted that the case involves offences under the NDPS Act and that the petitioner has one previous case in his credit. Hence, he opposed the grant of anticipatory bail to the petitioner.

5.Admittedly, this is a case of commercial quantity involving 1.30 grams of LSD stamps and that the petitioner has one previous case, this Court is not

inclined to go into the defence based on CDR and CCTV footage at this stage, as the same is premature. In view of the above and the petitioner's antecedents, this Court is of the firm view that the petitioner is not entitled for anticipatory bail.
