ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 304(2) of BNS, 2023 in Crime No.752 of 2025, seeks anticipatory bail.

2. The allegation against the petitioner is that the co-accused had allegedly involved in the chain snatching of the defacto complainant. Based on the confession of the co-accused, the petitioner herein has been arrayed as an accused. Hence, the case.

3.The learned counsel appearing for the petitioner submitted that this is the second anticipatory bail petition. He further submitted that the co-accused has been released on bail. Therefore, the question of custodial interrogation of the petitioner does not arise. Hence, the petitioner seeks anticipatory bail. 4.The learned Government Advocate (Criminal Side) would strongly oppose the anticipatory bail application on the ground that this is a case of chain snatching of five sovereigns of gold jewels, however the same has subsequently been recovered, and that the petitioner has no previous case against him.

5. I have given anxious consideration to the submissions made by the learned counsel on either side and also perused the records available.

6. From the submissions made by the learned Government Advocate (Crl.Side) it is seen that the petitioners have no bad antecedents. Considering

the nature and gravity of the allegations against the petitioner, if the petitioner is enlarged on bail, there is a possibility of him involving in similar offences. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
