ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2), 326 BNS read with 21(5) of Mines and Minerals (Development & Regulations) Act, 1957, in Crime No.408 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner joined hands with other accused involved in illegal quarrying and transporting half unit of river sand with the help of Tata Ace bearing registration number TN-25-AE-4705. Hence, the present complaint.

3. There is no representation for the petitioner.

4. The learned Government Advocate (Criminal Side), appearing for the respondent police, reiterated the case of the prosecution and, on instructions, submitted that the petitioner has one previous case similar in nature pending against him. Hence, he strongly opposed the grant of anticipatory bail to the petitioner.

5. From the submissions made by the learned Government Advocate (Crl.Side), it is seen that the petitioner has one previous case. This Court is of the firm view that exploitation of natural resources must be viewed seriously. Therefore, this Court is of the considered view that the petitioner does not deserve the grant of anticipatory bail. Hence, this Criminal Original Petition is dismissed.
