ORDER

The learned counsel for the petitioner would submit that since the 1st petitioner was arrested by the respondent police, as against him, the learned counsel for the petitioner has not pressed this application. Hence, this petition is dismissed as against 1st petitioner.

The 2nd petitioner herein apprehend arrest at the hands of the respondent police for the offences punishable under Sections 120(B), 409 & 420 of IPC and under Section 5 of TNPID Act and Sections 3, 5 read with Section 21, 23 & 25 of BUDS Act in Crime No. 3 of 2025, on the file of the respondent Police, seeks anticipatory bail.

3. The prosecution of the case is that the petitioner cheated the amount of the petitioner by induced him to invest in the business of her company. Hence, the complaint.

4. The learned counsel appearing for the petitioner submitted that the petitioner is innocent person and she has been falsely implicated in this case. He further submitted that the there are totally 14 accused in this case, except the fact that the she is wife of A7, she has no role to play in the said concern. It was further submitted that the petitioner is ready to co-operate with the investigation and abide by any other stringent conditions that may be imposed by this Court. Hence, he prayed for the grant of anticipatory bail to the petitioner.

5. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the 2/4

petitioner is also one of the partner in the concern and there are 58 victims affected by the conduct of the petitioner and the total amount cheated is Rs.8,86,63,900/- and that the Court has already issued warrant against the petitioner. It is the further submission of the learned Government advocate that unless the custody of the petitioner is taken, the recovery of money, which the petitioner diverted to the company by name Corex Info Solution, Zebu, Zerodha cannot be made. Hence, he vehemently opposed the grant of anticipatory bail to the petitioner.

Taking into consideration of the totality of the circumstances and the submissions made by the learned Government Advocate, this Court is of the view that the contention of the learned Government Advocate that the custodial interrogation of the petitioner is essential cannot be faulted, hence, this Court is not inclined to grant anticipatory bail to the petitioner.
