ORDER

The petitioners apprehend arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 115(2), 109 of BNS, in Crime No.63 of 2026, on the file of the respondent Police, seek anticipatory bail.

2. The case of the prosecution is that the petitioners attacked the defacto complainant with a knife. Hence, the case.

3. There is no representation for the petitioner.

4. From the submissions made by the learned Government Advocate (Crl.Side) it is seen that the second petitioner has already been arrested and released on bail. Hence, this Criminal Original Petition is dismissed as infructuous in respect of second petitioner.

5. As far as the first petitioner is concerned, he is a history sheeter with five previous cases. Considering the same, this Court is of the firm view that if the petitioner is enlarged on anticipatory bail, he would be emboldened to commit similar offences in future. Hence, this Court is not inclined to enlarge the first petitioner on anticipatory bail.

6. Accordingly, this Criminal Original Petition is dismissed in respect of first petitioner.
