O R D E R
The revision petition is filed seeking for a direction to Sub Court, Kancheepuram, to dispose of the case in LAOP No.167 of 2009 within the stipulated time.
2. Mr.Veeraraghavan, Party-in-person submitted that his land in Survey No.177/2005 was acquired by the Government. Under Section 18 of the Land Acquisition Act, the matter was referred and it is pending before the Court from the year 2002. On 19.11.2013, he was examined as CW1 and he also produced the documents. Thereupon, the case was adjourned for cross examination, however, the learned Government Pleader, without any justification, has been taking adjournments. The petitioner further submitted that he is now aged 81 years and he has appeared for more than 35 times before the trial court. The petitioner further submitted that inspite of strong objection by the petitioner, the Sub Judge, Kancheepuram , in a routine manner, has been adjourning the case.
3. The respondent is present before this Court. Mr.Venugopal, learned Special Govt. Pleader (CS) submitted that now the respondent is ready to get along with the case and it is further submitted that the case can be transferred to District Court for speedy disposal.
4. Considering the facts of the case and the submissions of the petitioner as well as the learned Special Government Pleader, the LAOP No.167 of 2009 is transferred from Sub Court, Kancheepuram to District Court, Kancheepuram. The learned District Judge, Kancheepuram shall dispose of the
LAOP No.167 of 2009 as expeditiously as possible, preferably, on or before 30.4.2015. The Sub Court, Kancheepuram is directed to transfer all the relevant papers to District Court, Kancheepuram immediately, without any delay. 02.03.2015 ds/rgr Index : Yes/No Note : Issue order copy by 02.03.2015 To
