This Criminal Miscellaneous Petition has been filed to implead the petitioner/proposed respondent, as the second respondent in the above Criminal Revision Petition.
2. Heard both sides and perused the materials available on record
3. It is seen that the petitioner's father lodged a complaint against the accused persons in Crime No.376 of 2011. On completion of investigation, the respondent-Police filed a charge-sheet before the Special Court or Land Grabbing Cases, Perambalur in C.C.No.11 of 2022 for the offences punishable under Sections 120-B, 420, 423, 465, 468 and 471 IPC. Now, the said calendar case was transferred to the file of the Judicial Magistrate No.1, Ariyalur and re-numbered as C.C.No.143 of 2023. Pending trial, the first respondent herein/A2 filed a petition in Crl.M.P.No.8410 of 2023 before the Judicial Magistrate No.I, Ariyalur, seeking to discharge him from the charged offences. The Court below 2/5
dismissed the petition on 04.02.2025. Challenging the same, the first respondent/A2 has filed the above revision petition.
4. Now, the present petition is filed seeking to implead the petitioner herein as a party respondent in the above criminal revision petition, since his father, who is the de-facto complainant in Crime No.376 of 2011 is no more.
5. Since the first respondent herein/A2 filed the above revision as against the second respondent herein/State, there is no need to implead the petitioner herein as a party respondent in the present revision. Hence, this criminal miscellaneous petition is dismissed.
6. Post the main revision petition itself for hearing on 08.04.2025.
7. Interim order already granted by this Court on 27.02.2025, is extended till then. If the revision petitioner/A2 fails to proceed with the case further, the interim order shall stand vacated automatically. 3/5
