Respondent PRAYER: Petition filed under Section 24 of the Civil Procedure Code to order withdrawal of the I.D.O.P.No.2261 of 2016 from the file of II Additional Family Court, Chennai and transfer the same to the Principal District Judge at Salem.

O R D E R

The learned counsel for the respondent would submit that the respondent is going to withdraw the OP from the file of the Family Court.

He has filed a memo dated 11.08.2017 to that effect and the contents of the same reads as under:

"Memo filed by Respondent The respondent herein submits as follows:

The respondent states that the respondent has filed a petition OP No.2261 of 2016 before the II Additional Family Court, Chennai for divorce and the same stands reposted to 4.8.2017. Meanwhile the respondent filed the above transfer petition and obtained interim stay. The respondent states that he is intend to withdraw the above OP No.2261 of 2016. However due to the stay granted by this Hon'ble Court, the respondent is unable to withdraw the same.

It is therefore prayed that this Hon'ble Court may be pleased to vacate the interim orders granted in CMP No.2478 of 2017 to enable the respondent to withdraw the OP No.2261 of 2016 and thus render justice.

2. The memo dated 11.08.2017 filed by the respondent is recorded and the Transfer Civil Miscellaneous Petition is closed as nothing survives for further adjudication. No costs. Consequently, connected civil miscellaneous petition is closed.
