ORDER

The petitioner apprehends arrest for the alleged offence under Sections 296(b), 267, 132 and 133 of BNS, 2023 in Crime No.333 of 2025, on the file of the respondent police, seeks anticipatory bail.

2. The allegation against the petitioners is that the petitioners while produced before the Judicial Magistrate on execution of Non Bailable Warrant, he abused the officer in the Court. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. He also submitted that this is the second anticipatory bail petition, and that the earlier petition was dismissed by this Court in Crl.O.P. Nos. 32678 of 2025 by order dated 10.12.2025. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) reiterated the prosecution case and strongly opposed the bail petition on the ground that the petitioner has 3 previous cases. Hence, he opposed the grant of anticipatory bail.

5. I have given anxious consideration to the submissions made by the learned counsel on either side and also perused the materials available on record.

6. Considering the serious allegations against the petitioner, and the fact that he has three previous cases to his credit, which clearly demonstrate that he has subverted the course of justice whenever he was enlarged on bail, and also taking note of his deplorable conduct towards the woman Court staff, this Court is of the firm view that the petitioner does not deserve anticipatory bail. Accordingly, this Criminal Original Petition is dismissed. 27-03-2026 MPA To
