OP No.196 of 2018 R.SUBRAMANIAN.J., This original petition was filed by Mr.M.Dheenadhayalan, seeking issuance of Letters of Administration with the Will annexed for the last Will and Testament dated 10.08.2001, executed by M.Duraisamy Gramani. The said M.Duraisamy Gramani, died issue-less on 18.03.2002. M.Dheenadhayalan, claims to be a legatee under the Will, since he died pending Original Petition, his wife has been brought on record as his legal representative, as per the order dated 27.06.2018 made in Application No.4638 of 2018.
2. The petitioner Mrs.Usha Nandhini, has been examined as P.W.1. She has produced the Original Will as Ex.P1. She also produced the copy of the death certificate of the deceased M.Duraiswamy Gramani, as Ex.P2 and the death certificate of the deceased Dheenadayalan as Ex.P3. The original Legal Heirship Certificate of the deceased Dheenadayalan has been marked as Ex.P4. The petitioner has also examined P.W.2 and P.W.3, namely Mr.B.Gopal and Mr.R.Suresh, who are the attesting witnesses to the said Will. Both of them have spoken about the execution of the Will by the testator in their presence and its attestation by them in the presence of the testator. http://www.judis.nic.in

3. In view of the above, I find that the petitioner has proved the execution of the Will and is entitled to letters of administration. Hence, the original petition is allowed granting letters of administration with the Will annexed for the last Will and testament of M.Duraisamy Gramani, dated 10.08.2001.
