PRAYER : Petition filed Under Article 226 of the Constitution of India praying to issue Writ of mandamus to direct the first respondent to declassify the land in S.No. 4B/1, in Kilseesamangalam Village, Vandavasi Taluk, Thiruvannamalai District from Thoppu Poramboke to dry (g[d;bra; jhpR) land and allot 2 acres to the petitioners as per the recommendations by the third respondent dated 28.08.2007.

By consent of the learned counsel on either side, the writ petition is taken up for final disposal.

2.Heard Mr.S.Baskaran, learned Counsel appearing for the petitioner, and Mr.R.Vijayakumar, learned Additional Government Pleader appearing for respondents.

3.The petitioners seek for issuance of a writ of mandamus to direct the first respondent to declassify the land in S.No. 4B/1, in Kilseesamangalam Village, Vandavasi Taluk, Thiruvannamalai District from Thoppu Poramboke to dry (g[d;bra; jhpR) land and allot 2 acres to the petitioners as per the recommendations by the third respondent dated 28.08.2007.

4.According to the petitioners they are entitled to grant of pata in respect of two acres of land as per the Scheme announced by the Government in G.O.Ms.No.555, Revenue dated 26.8.2006. The petitioners would further state that the Tahsildar has recommended their application in 2007 itself and the same is pending before the first respondent.

5.In the light of the above, without going into the merits of the case, the first respondent is directed to consider the recommendation of the Tahsildar and consider the petitioners' request on merits and in accordance with law, as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order. No costs.
