Respondents Prayer:- Criminal Original Petition filed under Section 482 Cr.P.C. to direct the respondents herein to provide police protection to the petitioner's land and house properties situated in Sy.Nos.18/2, 129/1, 143/1, 172/8 ad 182/3 of Kotamadugu Village Sy.Nos.880/1, 825, 826/3, 839/9 and 792/6 of Dodda Ubbanur Village and houses in Sy.No.634/3 and Sy.No.635/3 of Thally Village, Denkanikottai Taluk, Krishnagiri District by considering petitioner's letter dated 22.03.2019. O R D E R

This petition has been filed seeking for police protection to the petitioner's land.

2. It is seen from records that there is a property dispute between the petitioner and his relatives. In this respect a civil suit is also pending in O.S.No.76 of 2018 filed by the counter part, before the learned Additional District Juge, Hosur. It is also seen that there are complaints registered and also a counter complaint before the 3rd respondent police. Now, the petitioner seeks protection to his properties from his own relatives.

3. The learned Additional Public Prosecutor would submit that the respondent police cannot give police protection in a case of this nature, since, admittedly, the suit is pending before the Court below and also that the dispute is between the relatives.

4. Heard both sides.

5. In view of the above submission, the prayer sought for by the petitioner cannot be entertained. Accordingly, this Criminal Original Petition is dismissed. However, the petitioner is at liberty to workout his remedy before the appropriate civil court in the manner known to law.
