Prayer:- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Mandamus, directing the fourth respondent to cancel the electricity service connection bearing No.577-08-1837 give to the fifth respondent to a property comprised in Survey No.106/1 in Senkuruchi Village, Ulundurpettai Taluk, Kallakuruchi District. ORDER
This Writ Petition has been filed forbearing the fourth respondent to utilize the electricity service connection standing in the name of the fifth respondent for the property comprised in Survey No.106/1 in Senkuruchi Village, Ulundurpettai Taluk, Kallakurichi District in Electricity Service Connection No.577-08-1837 and cancel the same.
2. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents 1 to 4 and perused the materials available on record.
3. It is seen that there is a title dispute in respect of the
subject property between the petitioner and the fifth respondent. Even before raising of objections, the fourth respondent provided electricity service connection in favour of the fifth respondent for the subject property. If at all, the petitioner proved his title deed before the Civil Court, he can very well to approach the fourth respondent for disconnection of the electricity service connection.
4. In view of the above, the prayer sought for in this writ petition cannot be considered. Thus, the writ petition is devoid of merits and is liable to be dismissed. Accordingly, this writ petition stands dismissed. Consequently, connected miscellaneous petition is closed. No costs.
