The petitioner has filed this writ petition challenging the impugned order passed by the first respondent in his proceedings No.Pa.MU.No.33337/N2/2006 dated 19.09.2006.

2.When there is an remedy available to file an Appeal by invoking Section 47(A)(10) of the Indian Stamp Act, filing the writ petition under Article 226 of the Constitution of India is not sustainable in law. Accordingly, this writ petition is disposed of with a liberty to the petitioner to file an Appeal under Section 47(A)(10) of the said Act. The period in which this petition was pending before this Court can be excluded for the purpose of limitation. No costs. Consequently, the connected miscellaneous petition is closed.
