ORDER

The decree holder is before this court seeking early disposal of E.P.No.24 of 2011 filed by him to execute the decree passed in O.S.No.102 of 2002 dated 31.8.2010 against the respondent. The suit has been filed seeking declaration and for recovery of possession of the suit property and the said suit was decreed as early as 31.8.2010 and E.P. was filed on 10.1.2011.

Notice to the respondent is not necessary in the above matter, as this Court only directs the Trial court to dispose the E.P. When the matter is disposed of in the admission stage, no prejudice would be caused by passing this order. Hence notice to the respondent is dispensed with.

It is seen that though appeal has been filed, it has not been numbered. In view of the above position, the Executing Court is directed to dispose of the E.P. on or before 30th June, 2015. The transfer petition is disposed of. No costs.
