PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the first respondent to give appointment to the petitioner on the basis of compassionate ground as the petitioner's father died in service in Electricity Board.

Heard Mr.Akshai Sajin Kumar, learned counsel appearing for the petitioner and Mr.P.Subramanian, learned Standing counsel appearing on behalf of the respondents 1 & 2.

2. The petitioner herein is the son of Late R.Palanivel, who died in harness, while under the service of the respondents' Electricity Board. The petitioner herein has made an application after about 13 years seeking for compassionate appointment. The scheme of compassionate appointment under the respondents' Board provides, inter-alia, an application to be made on conditions that the applicant must have completed 18 years of age with a minimum educational qualification of VIII Std and such application requires to be made, within a period of three years from the date of death of the employee.

3. In the instant case, there are no records to show that the application for compassionate appointment was made by the petitioner, within a period of three years as prescribed by the Board. Apparently, the petitioner was a minor when his father had expired. In 2/4

the absence of any evidence to show that an application has been properly made within the specified time, the present request of the petitioner for compassionate appointment, cannot be sustained. Accordingly, the Writ Petition stands dismissed. There shall be no order as to costs.
