PRAYER - This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Certiorarified Mandamus, calling for the records pertaining to the proceedings of the Fourth respondent in Na.Ka. No.1164/ 2022/ A2 dated 13.07.2022 and quash the same and consequently direct the fourth respondent to issue patta to the petitioner for the remaining un-acquired portion of petitioner's land as per sale deed Doc. This Writ Petition has been filed calling for the records pertaining to the proceedings of the Fourth respondent in Na.Ka. No.1164/ 2022/ A2 dated 13.07.2022 and quash the same and consequently direct the fourth respondent to issue patta to the petitioner for the remaining un-acquired portion of petitioner's land as per sale deed Doc. No.2420/1990 of S.R.O. Poonamallee comprised in S.Nos.399/3C and 400/9 of Morai Village.
2.The case of the petitioner is that the petitioner had purchased a residential plot measuring 2400 Sq. Ft. comprised in Survey Nos.399/3C and 400/9 of Morai Village, Ambattur Taluk (presently Avadi Taluk) in the year 1990, of which the 1st respondent had acquired 800 Sq. Ft plot for 400 Feet outer Ring Road Project owned by the 3rd respondent. The petitioner had also received the compensation for the said lands acquired. In the circumstances, the petitioner approached the 4th respondent for issuance of patta for the remaining 3/4th area of the plot admeasuring to an extent of 1600 Sq. Ft. in the year 2019.
Since the sketch pertaining to the acquisition of the petitioner's plot survey number was not available with the 4th respondent Taluk as it had been just formed after bifurcation from Ambattur Taluk, the petitioner requested the 1st respondent vide letter dated 27.01.2020 to send the said acquisition details to the 4th respondent. The 1st respondent by letter dated 03.02.2020, forwarded the requested details to the 4th respondent. Thereafter, the petitioner has also given an application to the 4th respondent on 04.02.2020, requesting for issuance of patta for the remaining plot area. The 4th respondent, after conducting an enquiry, sent a letter dated 13.07.2022 to the 2nd respondent stating that the entire area of the petitioner's plot has been acquired in the Outer Ring Road project as per the Award No.
20/2006 of the 1st respondent dated 30.11.2006.
3.According to the petitioner, neither the 1st respondent had taken over the entire plot purchased by the petitioner, nor had he received compensation for the entire plot owned by him. The 1st respondent, thereafter, called the petitioner to appear for enquiry along with original documents on or before 15.12.2022, by notice dated 11.11.2022. The petitioner submitted all the relevant documents to the 1st respondent on 12.12.2022. Though the 4th respondent issued an impugned letter dated 13.07.2022 to the petitioner, till date they have not issued patta to the remaining part of the land owned by the petitioner. Hence, the present Writ Petition.
4.Though the petitioner has sought for larger relief, Mr.T.K.Saravanan, learned Additional Government Pleader, appearing for the respondents 1, 2, 4 and 5, submitted that it would be suffice to issue a direction to the 4th respondent to consider the representation dated 04.02.2020 given to him by the petitioner. In case the petitioner has any further grievance, he can make a fresh representation including the communication dated 13.07.2022 sent by the Tahsildar/4th respondent to the District Revenue Officer/ 2nd respondent. 5.Heard the learned counsel on both side and perused the entire materials on record.
6.Considering the submissions made by learned Additional Government Pleader appearing for the respondents, this Court directs the 4th respondent to dispose of the petitioner's representation dated 04.02.2020 on merits and in accordance with law and pass a speaking order, taking into consideration the submissions, documents produced by the petitioner and also reply, if any, filed for the Tahsildar's communication to the District Revenue Officer dated 13.07.2022, within a period of twelve weeks from the date of receipt of a copy of this order, after affording an opportunity of personal hearing to the parties. 7.With the above direction, this Writ Petition is disposed of.
