Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the second respondent herein to issue patta to the petitioner for the property situated at Plot No.130, admeasuring an extent of 1878 sq.mt. [2012 sq.ft.] comprised in Old Survey No.8/2 and New Survey No.155/2 [part] and old survey No.9, and New survey No.156 [part], as per Patta No.3311, in Survey No.155/2B1 situated at No.118, Padianallur Village, Ponneri Taluk, Tiruvallur District. ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

2. This writ petition is filed to direct the second respondent to issue patta to the petitioner for the property situated at Plot No.130, admeasuring an extent of 1878 sq.mt. [2012 sq.ft.] situated at No.118, Padianallur Village, Ponneri Taluk, Tiruvallur District.

3. Heard learned counsel for the petitioner and the learned Government Advocate appearing for the respondents and perused the materials available on record.

4. The case of the petitioner is that he had purchased the subject property from Videsh Sanchar Nigam Employees Co-operative Housing Society for a valuable consideration and the title deeds were handed over to the petitioner. The grievance of the petitioner is that though he has given an application for name transfer in the patta, the same has not been considered by the second respondent. Hence, the present Writ Petition. 2/4

5. Considering the limited relief sought for in the Writ Petition, without going into the merits of the case, the second respondent is directed to consider the application of the petitioner for issuance of patta dated 17.06.2023 and pass Order on its own merits and in accordance with law, within a period of two months from the date of receipt of a copy of this Order.
