P.Kamalanathan v. P.Janarthanan
C.M.P.No.16215 of 2021 in S.A.SR.No.80615 of 2016 S.S.SUNDAR, J.
This petition is filed to condone the delay of 1205 days in representation of the Second appeal papers.
2.Though the delay is inordinate and the learned counsel for the respondent also seriously opposed this petition, with regard to the facts contained in the accompanying affidavit, this Court is unable to discard the reasons.
3.It appears that the petitioner engaged an advocate earlier who had failed to represent the papers promptly.
Since the delay according to the petitioner is caused by the precious counsel, this Court is unable to discard the reasons.
4.Hence, this petition is ordered.
5.The Registry is directed to number the second appeal for admission at an early date if the papers are otherwise in order.
