ORDER
The prayer sought for herein is for a writ of mandamus directing the respondents 1 and 2 to consider the petitioner's representation dated 13.06.2018 and dispose the same on merits within the time as prescribed by this Court.
2.It is the case of the petitioner that the private respondents have filed a suit in O.S.No.39 of 2015 on the file of the District Munsif Court at Thiruvottiyur against the petitioner who was the defendant in the suit in respect of the suit schedule property. In support of the claim made in the suit, the private respondents seems to have filed a copy of the
patta issued by the Revenue Department in respect of the property in the suit and on verifying the same, the petitioner, after getting a certified copy of the patta from the District Munsif Court, has doubted its genuinity and therefore, in order to clarify as to whether the patta issued in favour of the private respondents as shown one of the document is a genuine or valid document or not, the petitioner has given a representation to the second respondent Tahsildar on 13.06.2018 and the said representation since has not been considered and the necessary clarification sought for by the petitioner since has not been given, he has approached this Court by filing the present writ petition with the aforesaid prayer. 3.Heard Mrs.Malini George, learned counsel appearing for the petitioner, who having reiterated the aforesaid facts, would seek indulgence of this Court to give a suitable direction to the second respondent Tahsildar to pass orders on the representation of the petitioner dated 13.06.2018 within a time frame.
4.Heard Mr.N.Inbanathan, learned Additional Government Pleader appearing for the official respondents, who would submit that, the said representation of the petitioner dated 13.06.2018 seeking clarification with regard to the genuineness of the patta in question, would be considered and decided on merits and accordingly, a reply to that effect would be given to the petitioner within a time frame.
5.I have considered the said submissions made by the learned counsel appearing for the parties and by taking into account the innocuous nature of the prayer sought for, this Court is inclined to dispose of this writ petition with the following order:
That there shall be a direction to the second respondent Tahsildar to consider and pass orders on the representation of the petitioner dated 13.06.2018 and accordingly communicate the order to the petitioner within a period of eight weeks from the date of receipt of a copy of this order.
6.With this direction, this Writ Petition is disposed of. No costs.
