Prayer: Criminal Original Petition filed under Section 438 Cr.P.C. to enlarge the petitioner on bail in the event of his arrest in the Crime No.1331 of 2020 pending investigation on the file of the respondent.

ORDER

(The case has been heard through Video Conferencing) The petitioner who apprehends arrest at the hands of the respondent police for an offence punishable under Sections 379, 430 IPC, Section 21(5) of Mines & Minerals (Development & Regulation) Act, 1957 in Crime No.1331 of 2020 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found stealing 4 unit of Klin sand through Tipper Lorry and JCB. Hence, the complaint.

3. The learned Counsel for the petitioner states that the petitioner is an innocent person and has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that the petitioner has stolen 4 units sand to brick klin through JCB and Tipper Lorry. He would further submit that the petitioner is already having seven previous cases and he is a history sheeter. Hence, he opposed for the grant of anticipatory bail to the petitioner.

5. Taking into account, the facts and submissions made by the learned counsel, this Court is not inclined to grant Anticipatory Bail to the petitioner and accordingly, this Criminal Original Petition is dismissed.
