MINOR VARSHA RAJESHWARI REP.BY MOTHER AND NATURAL GUARDIAN Vs M.SARAVANAN [ RESPONDENT / PETITIONER ] Petition praying that in the circumstances stated therein the High Court will be pleased to direct the Learned Family Judge, Chengalpattu to release the amount, to the petitioners herein, deposited by the respondent husband herein in the light of the conditional interim stay granted by order dated 20/05/2016 in CRL.MP.NO.5436/2016 in CRL.RC.NO.728/2016 and thus render justice. Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.G.MAGESH KUMAR Advocate for the petitioner, the court made the following order:- This petition has been filed by the petitioners / wife and minor daughter seeking permission to direct to the learned Family Judge, Chengalpet, to release the amount to the petitioners herein deposited by the respondent / husband.
2. Heard both sides.
3. As per the conditional order of this Court, it is represented that 50% of the maintenance amount, as ordered by court below, has been deposited by the Revision Petitioner.
4. The learned counsel appearing for the petitioners seeks permission to withdraw the deposited amount.
5. The learned counsel appering for the respondenet stated No Objection to withdraw the said amount.
6. In view of the above, this petition is ordered as prayed for and the learned Family Judge, Chengalpet, is hereby directed to permit the petitioners herein to withdraw the deposited amount from F.C.M.C.No.32 of 2015, forthwith.
