Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondents to promote the petitioner as Middle School Headmaster as per provisions of Tamil Nadu Recognized Private School Regulation Act and Rules, by considering the representation of the petitioner dated 05.04.2017. ORDER

The petitioner, who was permitted to continue as Headmaster in-charge in the third respondent-Alagappa Middle School, Puttai, Sankarapuram Union, Villupuram District, has given a representation on 5.4.2017 stating that he is a fully qualified teacher to be appointed as the Headmaster of the third respondent School. Therefore, his representation requires to be https://hcservices.ecourts.gov.in/hcservices/

considered in the interest of the students at the earliest point of time, in view of some problem created by the fourth respondent to the petitioner to work as Headmaster in-charge, as per the provisions of the Tamil Nadu Recognised Private Schools Regulation Act and the Rules. Hence he is before this Court.

2. Mr.P.Sanjay Gandhi, learned Additional Government Pleader takes notice on behalf of the respondents 1 & 2.

This Court hereby directs the first respondent to consider the case of the petitioner for promotion as the Headmaster of the third respondent School, as per the provisions of the Tamil Nadu Recognised Private Schools Regulation Act and the Rules made thereunder, and pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order, after hearing the third and fourth respondents. The writ petition is disposed of accordingly.

Consequently, W.M.P.No.15316 of 2017 is closed. No costs.
