The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 354, 506(1) of IPC in Crime No.121 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution as per the defacto complainant XXX is that on 22.03.2023, she boarded a Government Bus bearing Regn.No.45 N 4069 at Trichy to go to Salem. When the bus reached Namakkal, all other passengers have got down and when she was alone in the bus, the bus driver and yet another person who were travelling in the bus, had misbehaved with the defacto complainant and when the defacto complainant called the police, the accused threatened her stating that if she informs to police, they will commit rape on her and murder her. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case since there was a quarrel between the petitioner and the defacto complainant in the bus. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police would submit that it is a case where the petitioner who is a Government bus driver along with his friend, misbehaved with a woman passenger while travelling in the bus. Further, they have threatened her to commit rape and kill her if she informs the same to the police. Hence, he vehemently opposed for grant of bail to the petitioner.

5. Taking into consideration the serious nature of offence, this Court is not inclined to grant bail to the petitioner.
