The petitioner, who was arrested and remanded to judicial custody on 10.04.2022 for the offences under Section 8(c) read with Section 20(b)(ii)(B), 25 and 29 (i) of NDPS Act in Crime No.19 of 2022, on the file of the respondent Police, seeks bail.

2.The case of the prosecution is that the petitioner along with other accused were found in possession of 100 Kgs of Ganja. Hence, the case. 3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that he has not committed any offence as alleged by the prosecution. He further submits that the petitioner has been suffering incarceration from 10.04.2022 onwards. Hence he prays for grant of bail to the petitioner. 4.The learned Government Advocate (Crl.Side) for the respondent submitted that the petitioner is having three previous case, apart from this case. He also submits that the contraband involved in this case is commercial quantity. He further submits that this is the second bail application. Hence, he opposed for grant of bail to the petitioner.

Considering the facts and circumstances of the case, there are three previous cases pending against the petitioner, the contraband seized from the petitioner is commercial quantity and there is no change of circumstances to release the petitioner on bail, this court is not inclined to grant bail to the petitioner.
