This petition has been filed to condone the delay of 1045 days in filing the above second appeal.

2. Heard the learned counsel for the petitioner.

3. Though notice served to the respondents and the name of the respondents are printed in the cause list, no one appeared on behalf of the respondents by persons.

4. On a perusal of the affidavit filed in support of the condone delay petition stating that the Executive Officer of the petitioner was appointed on 01.08.2007 as the Fit Person. The said Executive Officer was transferred frequently by the HR & CE Department. Therefore, he could not able to file in time.

5. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this miscellaneous petition is allowed on condition that the petitioner shall pay a sum of Rs.5,000/- (Rupees Five Thousand only) to the respondents on or before 13.03.2023, failing which this petition shall stand automatically dismissed.
