The prayer sought for herein is to extend the time frame of the Arbitral Proceedings in A.F.No.5 of 2018 in O.P.No.600 of 2017, before the Arbitral Tribunal [Mrs.M.Rajalakshmi, District Judge (Retd) Sole Arbitrator].

2. Heard the learned counsel appearing for the applicant. No one is appearing for the respondents

3. The learned counsel appearing for the applicant submits that, one year period for the mandate of the Arbitral Tribunal expired by 30.11.2017, thereafter six months period extended is also expiring by 30.05.2019.

4. In the meanwhile, since both the respondents initially set exparte, out of whom the first respondent alone has filed set aside petition which was allowed and the second respondent still remains exparte. Because of these, the pleadings is not completed, but anyhow now the first respondent has come forward to participate in the arbitration proceedings, the mandate of the Arbitral Tribunal if it is extended for a further period of six months, within which the Arbitration proceedings can be completed.

Considering the said submission made by the learned counsel appearing for the applicant, this Court is inclined to extend the mandate of the Arbitral Tribunal for a further period of six months from 30.05.2019 onwards, within which period, it is expected that the arbitration proceedings would be concluded and final award would be passed.
