This Writ Petition is filed under Section 226 of the Constitution of India praying for issuance of a writ of mandamus directing the second respondent not to interfere with the civil dispute in order to extend helps to the third respondent and giving threats to the petitioner and his family members to settle the money dispute, on the basis of the petitioner's representation dated 26.04.2021.

O R D E R

The relief sought for in this writ petition is to direct the second respondent not to interfere with the civil dispute in order to extend helps to the third respondent and giving threats to the petitioner and his family members to settle the money dispute, on the basis of the petitioner's representation dated 26.04.2021.

2. Heard the learned counsel on both sides.

3. It is seen that there is a dispute between the petitioner and the third respondent over money transaction with respect to sale or purchase of lorry. It is stated that owing such dispute, the third respondent threatened the petitioner with dire consequences for repayment of money. According to the petitioner, it is purely a civil dispute which has to be resolved only through the Court of law. However, on the basis of the complaint given by the third respondent, the second respondent is frequently calling upon the petitioner to appear before him for enquiry. It is also stated that the petitioner's family members were also threatened by the second respondent at the instance of the third respondent.

4. In this context, the petitioner has submitted a representation dated 26.04.2021 addressed to the respondents 1 & 2 stating that he and his family members were unnecessarily harassed by the second respondent at the instance of third respondent.

5. In view of the facts and circumstances of the case, the first respondent is directed to consider the petitioner's representation dated 26.04.2021, to conduct an enquiry thereof and pass appropriate orders on merits and in accordance with law.

6. This Writ Petition is disposed of with the above direction. No costs.
