Respondents Contempt petition filed under section 11 of the Contempt of Courts Act to punish the respondents for willfully disobeying the orders passed in W.M.P.No.30806 of 2017 in WP No.28633 of 2017 dated 09.11.2017. ORDER

This Contempt petition has been filed alleging noncompliance of the interim order passed by this Court in WP No.28633 of 2017 dated 09.11.2017. It is relevant to extract paragraph No.3 of the said order :- "3. The petitioner appears to be Senior most Professor in the dental college. Since the said communication dated 18.07.2017 does not contain / mention the name of the petitioner, the respondents shall consider the name of the petitioner along with Dr.L.Pushpa, Dr.S.P.Prem Kumar, Dr.Maheswari Rajendran, Dr.K.Malathy and report to this Court before finalizing the names for the post of Principal, Virudhunagar Government Dental College."

Mr.S.R.Rajagopal, learned Additional Advocate General appearing on behalf of the respondents submitted that the order which is the subject matter of this contempt petition has been complied with vide Letter No.26014/A1/2018-7 dated 09.09.2019, wherein, it has been clearly stated as to why the name of the petitioner has not been considered for inclusion in the panel for appointment of Principal.

This Court accepts the submissions of the learned Additional Advocate General and also the Letter No.26014/A1/2018-7 dated 09.09.2019 issued by the 1st respondent. The contempt petition is closed. Needless to state that it is open for the petitioner to challenge the order of the 1st respondent in considering the name of the petitioner.
