PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to consider the petitions dated 23.12.2010 and 7.3.2011 as well as grant the house allotment to the tsunami victim Mr.Siva in the Notchi Kuppam Slum, Mylapore, Chennai-4.

ORDER

The petitioner, who is a tsunami victim, has come up with the above writ petition seeking a direction to the respondents to consider his representations for allotment of a house. (2)

2. Heard Mr.R.Arunkumar, learned counsel for the petitioner. Mr.R. Vijayakumar, learned Additional Government Pleader takes notice for the first respondent. Mr.B.Kesavan, learned Standing Counsel takes notice for the second respondent.

3. The petitioner claims that he belongs to fisherman community. The residential house in his occupation got damaged by the tsunami attack in the year 2004. Therefore, the petitioner sent two representations dated 23.12.2010 and 7.3.2011 to the first respondent seeking allotment of a house. Since it did not evoke any response, the petitioner is before this Court.

4. It is seen that the petitioner sent another representation dated 3.12.2014 to both the respondents. It must be remembered that it is since ten years the petitioner is left stranded due to tsunami attack.

5. Therefore, without expressing any opinion on the merits of the case, the writ petition is disposed of with a direction to the second respondent to consider the representation of the petitioner dated 3.12.2014 on merits and pass appropriate orders thereon in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. No costs.
